Because we agree with the defendants contention in reference to the error of the trial court in denying the motion to suppress, we do not reach the second argument. Defendant was arrested in Denver on January 10, 1968, at approximately 1:00 a.m. The officers had no search warrant. The question to be determined is whether they had probable cause to arrest defendant and to search him and the automobile in which he was riding.
